General Terms and Conditions

Refunds

We cannot give refunds if you change your mind. If you are unhappy with the product or the product is damaged, please get in touch within 24 hours of receiving the product.

Cancellations

You may cancel your order any time up until the order has been shipped.

Delivery

Once your order and payment are received the goods will be packaged and dispatched to you within 24 hours. You will receive an email notification once the package has been sent.

A courier company will deliver the package to your door within 1-3 working days from the time of dispatch (this may be longer for rural deliveries).

Please note deliveries only take place on weekdays i.e. Monday to Friday. There are no deliveries on Saturday, Sunday or Public Holidays.

The address supplied must be a street address as our courier will not deliver to any Post Office box.

Shipping Costs

Auckland City - Orewa, Helensville, Titirangi, Pukekohe, Drury, Howick and everything in between. $6.50 per order. Waiheke Island orders will be posted through NZ Post.

North Island – everything in the North Island outside of the Auckland area $8.50 per order

South Island - $10.00 per order

NB Free shipping on orders $80.00

At the shopping cart the courier cost will be displayed for you to select based on your location.

Hire Pickup/Delivery Information

Hire Equipment

Pick up and Drop off of Hire Equipment is from New Lynn. All Hire equipment is for 3 days and must be picked up and delivered as per the Terms and Conditions.

We can deliver and pick up within the Auckland area. From within the Albany, Henderson, Howick and Papakura area. This will be at a cost of $35 each way.

Bouncy Castle Delivery

There is no delivery charge for the hire of the Large Bouncy Castles. This is included in the hireage fee.

Free delivery to the Auckland area (Albany, Henderson, Titirangi, Papakura and Howick and area within.)

Please enquire for a price if outside of this area.

Toddler Bouncy Castle Delivery

Our toddler sized bouncy castle is for 3 days hire.

Delivery is not included in the cost.

Pick up and drop off is from New Lynn. Pick up and drop off of hire equipment is from Blockhouse Bay. All hire equipment is for 3 days and must be picked up and delivered as per the terms and conditions.

Delivery within the Auckland area (Albany, Henderson, Titirangi, Papakura and Howick and the area within) will be available at a cost of $35 each way.

Mobile Bar Delivery

There is no delivery charge for the hire of the mobile bar. This is included in the heritage fee.

Terms and Conditions for Hire Equipment

For the purpose of these Terms ‘we/us/ours’ refers to Backyard Parties Ltd and 'you/your/the hirer' is defined as the person or persons hiring the item/s from Backyard Parties Ltd, and whose name and details are recorded at the time of booking.

The hirer must sign the “Hire Agreement” (which incorporates these Terms & Conditions) at the time of collection.

Payment can be made by way of direct credit into our Bank Account or cash on collection. Details will be supplied with your booking confirmation. A deposit of 50% is required to secure your items.

Deposit will not be refunded if cancellation occurs within two weeks of the date of hire.

Hire charges MUST BE PAID IN FULL before the hire can commence.

The hire commences on the start date as indicated on the hire agreement and continues until the finish date or until you return the Equipment to us (whichever is later).

You acknowledge that overdue Equipment will automatically be charged an additional full standard hire charge per item plus a late penalty fee of 50% of its standard hire charge for each day until the item is returned to us. Any amounts remaining unpaid after 28 days will be forwarded to a Debt Collection Agency and any costs incurred as a result of the collection of an overdue account will be payable by you.

You are responsible for inspecting the Equipment before Hire Commences. By signing the agreement you acknowledge that you are satisfied with the condition of the items. We will not take responsibility for shortages or claims once The Hirer has taken possession.

You will take proper care of the Equipment and be solely responsible for the return of the items in the same state of repair and cleanliness as when they were collected.

A security bond of $50.00 will be required to cover misuse, damages to Equipment. This is added to your total hire charge amount and is payable before hire can commence.

The bond will be returned to you via direct credit to your nominated bank account within 7 days of the return date if all Equipment is returned clean and in a satisfactory condition.

We have carefully selected items for our hire that are durable, hard wearing and difficult to break which means we expect breakages to be rare.

Some wear and tear is expected and this will be allowed for. The bond may be used to cover the cost of additional cleaning charges should the equipment not be returned clean or insufficiently cleaned. Any use of your bond will be advised to you by email within 7 days of its return. Any costs incurred beyond the $50.00 bond amount will be invoiced to you with strict 14-day payment terms.

You shall be responsible and indemnify us against any loss or damage to the hire items. In the event of a loss or theft of the items supplied, you must immediately notify us and you will be responsible for the replacement value of the item or items. This amount will be invoiced to you with strict 14-day payment terms. Outstanding amounts will be forwarded to a Debt Collection Agency and any costs incurred by us in respect of the collection of an overdue account will be payable by you, any collection fees incurred will be added.

All prices quoted on the Backyard Parties Ltd website and on the hire agreement are inclusive of GST and we reserve the right to amend prices at any time without notice.

The Equipment supplied for hire by us will remain our exclusive property. The agreement is personal to you. You will not lend, sell, or underlet any items supplied for hire without prior consent.

Signing of the hire agreement indicates acceptance of instruction for the safe use of the hire equipment and acceptance that the Hirer has read, understood and agreed to all of the stated hire Terms & Conditions of Backyard Parties Ltd. No hire will be entered into without the signing of the agreement.

We do not assume responsibility for or in any way guarantee your event. We shall not be liable and the Hirer or their nominated carer hereby releases us from any loss or damage howsoever arising (whether arising from negligence, personal injury, death, property damage, or infringement of third party rights or otherwise). We do not accept any liability as a result of a failure to comply with specific instructions and under no circumstances will we be held liable for any injury caused by or arising from items supplied. The Hirer must ensure that any or all children using any equipment supplied by us are supervised by a competent person at all times.

In the event of loss or theft of the items hired, the Hirer must provide a police report in the case of theft and a signed statement in the case of loss. Full replacement value will be charged.

Backyard Parties Ltd collects and retains in its database personal information gathered from our website, emails or Facebook for the purpose of advising of new products, services and special offers.

It is our intention to maintain your privacy at all times. If at any such time you wish to withdraw from our database, please contact us and we will have your name removed.

Terms and Conditions for Inflatable Hire

"Hirer" refers to any person or persons, company, business, organisation and or group, hiring equipment from Backyard Parties Ltd.

All items delivered or picked up by/to the Hirer remain the responsibility of the Hirer from the time of 'pick up' or 'set up' until the time of drop off or collection by Backyard Parties Ltd staff.

All equipment will be returned complete, clean, dry, undamaged and in full working condition as received.

If returned damaged, the Hirer will be responsible for all repair costs and charges undertaken by our designated repairer.

If returned wet, a drying charge will apply if this was done purposely. i.e. not weather related.

If returned dirty i.e. drink or food spillages, face paint, stains, glitter, excessive dirt or sand etc.  A cleaning fee will be applied.

Hirer must provide a flat, dry, easily accessible site for 'setup'.

 Backyard Parties Ltd staff will not be responsible for lifting heavy items up and down stairs or over fences etc. and may cancel the hire at their discretion if these obstacles are present.

Backyard Parties Ltd reserves the right to cancel any hire that our staff decide may be dangerous or jeopardise safety in any way.

The Hirer authorises Backyard Parties Ltd to bring its vehicle and equipment onto their property to deliver and to recover the equipment.

The Hirer or responsible representative must be present when Backyard Parties Ltd arrive to 'set up' at the designated time and place.

The equipment shall not be moved from the site upon which it was delivered and 'set up', without the authority of Backyard Parties Ltd.

A hire term can be for 4, 6, 8 hours generally of the Hirer's choosing between the hours of 9am and 5pm though some flexibility may apply in the summer months.

The Hirer must ensure the following:

That no children play near the electric blower or power lead at the rear of the inflatable.

That no shoes are worn, no food or drink consumed on the inflatable and no sharp objects be allowed on or near the inflatable.

That no smoking, BBQ's or hot sources be around the inflatable.

That no pets or animals are allowed on the inflatable or associated equipment.

No face paints (unless completely dried), silly string or poppers to be used on the inflatable. If face paint does get on the inflatable please wipe clean immediately with a damp cloth.

That the inflatable not be purposely wet or unduly soiled during the hire period.

That adult supervision is provided at all times while the inflatable equipment is in use.

That for the users own safety and the safety of the equipment, there must be no climbing over the walls of the inflatable.

Strictly no adults to jump on our inflatable’s.

If the blower cuts out for any reason get the children out of the inflatable as fast as you can, recheck the blower and electrical lead and re-plug in.

Backyard Parties Ltd accepts no liability for any claims in respect of any injury to persons or damage to property arising out of the use of the inflatable equipment however caused. The Hirer shall be responsible for any permits that may be required to operate the equipment and hereby indemnifies Backyard Parties Ltd from any penalties or other obligations incurred due to the Hirer's failure to obtain or comply with any such permit.

The Hirer will be liable for any costs or penalties due to the equipment creating an obstruction including without limitation any local authority fines, towage costs, seizure or impoundment costs during the hire period.

In the event of any damage to the equipment, the Hirer shall

1) Immediately notify Backyard Parties Ltd by telephone at the number provided on the invoice/agreement

2) Return the equipment or make arrangements to have the equipment collected.

3) Not attempt to repair the damage in any way.

4) Be liable to Backyard Parties Ltd for the sum equivalent to the cost of making good the damage whether by repair by our designated repairer or replacement if repair is not an option.

In the event of loss of the equipment the Hirer shall pay Backyard Parties Ltd the sum equivalent to the cost of replacing the lost equipment.

In the event of Backyard Parties Ltd being unable to retrieve its equipment from the Hirer at the conclusion of the hire, or if the Hirer does not return the equipment at the designated return time, then costs for additional hours will be calculated and added e.g. overnight hire fee will be charged. Where this additional payment is not made, collection will be referred to Baycorp and all recovery costs and fees will be added to the total amount owing.

Payment Policy

It is Backyard Parties Ltd policy to collect payment in cash at the time the hire begins. That is, upon delivery or pick up unless other arrangements have been made prior.

Where payment is not made, collection will be referred to Baycorp and all recovery costs and fees will be added to the total amount owing.

Backyard Parties Ltd accepts Direct Credit and cash.

If Backyard Parties Ltd staff arrive at your venue to deliver and you cancel, the full amount of the invoice is payable.

Weather

If the weather is likely to be a deterrent on the day of hire, the Hirer must contact Backyard Parties Ltd as early as possible either the night before or early morning on the day of hire to cancel.

We must have sufficient notice so as not to send our staff out on the delivery. If insufficient notice is given, the full amount of the invoice is payable.

Backyard Parties Ltd equipment is 'shower resistant' and can therefore be used on hires' where occasional showers may prevail. We cannot however setup in heavy rain or extreme high wind conditions.

Additional

After hours hires will incur an additional fee where applicable. Generally this is outside the hours of 9am and 6pm

Overnight hires are available on request where Backyard Parties Ltd deem the site to be secure. On these occasions it is the Hirer's responsibility to ensure full security and safety of equipment.

Power must be available within 25 meters of the equipment 'set up'. One only power lead, supplied by Backyard Parties Ltd may be used.

Generators may be used at un-powered locations.

Where Backyard Parties Ltd chooses to accept hires outside the Auckland central area an additional delivery fee will apply.
